Construction Site Laborer Who Suffered Wrist and Back Injuries from a Fall from Unsafe, Job Made Scaffolding Receives $90,000 Settlement

This was a construction site accident case where plaintiff suffered back injuries when he fell from makeshift scaffolding. Defendants violated federal and New Jersey law on this job site in that OSHA enforcement was completely non-existent and there was absolutely no safety management. The accident occurred on a job site located in Lyndhurst, Essex County, New Jersey.

At the time of the accident plaintiff had been directed to work on makeshift scaffolding installing a micro beam framing structure in the foyer of the building. The makeshift scaffolding was about 2 to 3 feet wide, 6 to 7 feet long and 13 to 14 feet high. It had been constructed from scraps of wood scattered around the job site. Pieces of wood were nailed to the studs on the wall to act as a ladder for access to the scaffold. The scaffold platform did not contain a guardrail. While plaintiff was working on this makeshift scaffold, he was instructed to climb up and down the scaffold many times to carry tools and materials. Plaintiff had to use the braces in the walls to climb up and down the makeshift scaffolding since there was no ladder or any other device for him to use. When plaintiff descended the scaffolding to get materials for his boss, he grabbed onto a brace in the wall to hold onto for climbing down the makeshift scaffolding when the brace came loose causing plaintiff to fall to the ground and suffer severe injuries.

The litigation settled for $90,000 after two days of trial.
